JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The case has been registered under Sections 302, 328/34 of the Indian Penal Code. Petitioner being mother in law of the deceased is languishing in jail custody since 02.09.2016. The impugned order goes to show that cause of death of the deceased was strangulation. The dead body of the deceased was found in the house of the petitioner but none has seen the actual killing of the deceased and the present case hinges upon circumstantial evidence. The investigation against the petitioner appears to have already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.46831 of 2016 (2) dt.26-10-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Jagdishpur (Ayer) P.S. Case No. 145 of 2007.
