The petitioner seeks bail in a case instituted for the offences punishable under Sections 385 and 506 of the Indian Penal Code and later on added Sections 386, 387, 474, 420 and 201/34 of the Indian Penal Code and Section 61(i) of I.T. Act. It is alleged that on the date of occurrence call of ransom was received on the mobile of the informant bearing No. 7764064052 by 7632082167. From the impugned order it appears that during course of investigation, it came that aforesaid mobile belongs to this petitioner.

It has been submitted on behalf of the petitioner that he gave his photograph and I.D card for issuance of SIM and the

Patna High Court Cr.Misc. No.54098 of 2016 (2) dt.21-12-2016 2/2 SIM was used by Rupesh Kumar for the aforesaid purpose. Be that as it may, the petitioner is not named in the FIR, the name of the petitioner has come during investigation. It is merely a ransom call which was made by the mobile No. alleged to belong to the petitioner on the mobile no. of the informant. The petitioner is in custody since 15.01.2016 and it has been submitted in para-3 of the bail petition that petitioner has no criminal antecedent.

In the aforesaid circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Naugachia, in connection with Naugachia P.S. Case No. 180 of 2016.
