The application is for grant of bail for the offence under Sections 419, 420, 467, 468, 471, 475, 120B and 34 of the Indian Penal Code and Section 25 (1-b) a/26/35 of the Arms Act. The allegation against the petitioner is that one 315 Bore Rifle and 27 cartridges were recovered form the possession of the petitioner.

It is submitted on behalf of the petitioner that the coaccused, having similar allegation, has already been granted bail by this Hon'ble Court, vide order dated 24.11.2016 passed in Cr. Misc. No.42175 of 2016 and the petitioner is in custody since 03.07.2016.

No.54708 of 2016 (2) dt.21-12-2016 2/2 Having heard both sides and in view of the fact that though one Rifle of 315 Bore and 27 cartridges were recovered form the possession of the petitioner and the petitioner and others are engaged in trading of the arms in other State but considering the fact that the petitioner is in custody since 03.07.2016 and the charge-sheet has been submitted and the other co-accused, having similar allegation, has already been granted bail by this Hon'ble Court, let petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of CJM, Siwan in connection with Siwan (Muffasil) P.S.Case No.

273 of 2016, subject to condition that the accused above named shall not, directly or indirectly, make any inducement, threat or promise to any person acquitted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer or tamper with the evidence and shall appear, in the learned court below, as may be directed. In terms of the above observations and directions, this bail application stands allowed.
