This application, for grant of anticipatory bail, arises out of Tatarpur (University) Police Station Case No. 266 of 2018, disclosing offences under Sections 143, 341, 323, 447, 354B, 325, 504, 506 and 307 of the Indian Penal Code. Learned Counsel appearing on behalf of the petitioner has submitted that the husband of the petitioner and the petitioner are agnates. Prior to registration of the present First Information Report, on 29.11.2018, the petitioner's wife had filed a First Information Report, registered as Tatarpur (University) Police Station Case No. 265 of 2018. On perusal of the two First Information Reports,

Patna High Court CR. MISC. No.20568 of 2019(2) dt.03-04-2019 2/3 which have been brought on record, it transpires that it is because of the inimical terms, which the parties are having, the cases are being filed.

Learned Counsel for the petitioner has submitted that if any anticipatory bail application is filed in Tatarpur (University) Police Station Case No. 265 of 2018, the informant of that case shall not oppose the prayer for anticipatory bail. This application, in view of the above submission, is allowed.

Let the petitioner, namely, Anand Kumar @ Anand Yadav, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Bhagalpur, in connection with Tatarpur (University) Police Station Case No. 266 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail
