In this case, the petitioner is seeking bail in connection with Bahera P.S. Case No. 59 of 2016 registered for offences under sections 147, 148, 341, 323, 324, 307, 354 and 302 of the Indian Penal Code.

As per First Information Report, the accused persons surrounded and assaulted the victim and, in pursuance thereof, he died.

This Court had called for a case diary. From perusal of the same, it appears that there is no direct allegation against the petitioner and other similarly situated persons have been granted bail by this Court.

Patna High Court Cr.Misc. No.51949 of 2016 (3) dt.18-01-2017 In that view of the matter, let the petitioner, namely, Madan Paswan, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P.S. Case No. 59 of 2016.
