JUSTICE SATYAVRAT VERMA ORAL ORDER 24-01-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek regular bail in connection with Khizarsarai P.S. Case No. 338 of 2020 instituted for the offences under Sections 341, 342, 323, 307, 337, 338, 448, 504, 506/34 and 302 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are in custody since 04.11.2020 and are persons with clean antecedent.

The informant in the FIR alleges that Nanhu Manjhi and Ramjeet Manjhi along with other assaulted Santosh

Further Dhirendra Manjhi along with other named accused persons assaulted the informant by brick, rod and stick causing fracture on the head. Further in the assault Sunil Chaudhary and Upendra Chaudhary also suffered fracture on head. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case by alleging serious allegation of assault on vital part of the body. Learned counsel further submits that from the side of petitioners Khizarsarai P.S. Case No. 339 of 2020, under Sections 307, 325 and other Sections of the Indian Penal Code, has been instituted against the side of the informant in which the side of the petitioners have also suffered injury. Learned counsel also submits that injuries of the injured in the present case are simple in nature.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody, are persons with clean antecedent, charge-sheet has been submitted and injuries have been found to be simple in nature, let the petitioners above named be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand)
