Petitioner is in jail custody since 9.3.2016 in a case registered under sections 420, 379 of the IPC and earlier his prayer for bail was rejected by this court on the ground that the petitioner was identified in test identification parade.

Submission on behalf of the petitioner is that up till now, only charge could be framed against the petitioner and moreover, alleged offences are triable by court of Magistrate. Considering the period of detention of the petitioner in jail custody as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Industrial Area P.S. Case no. 133/2015.
