JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-02-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Dhaka P.S. Case No. 266 of 2019 registered for the offences under Sections 354, 354(A), 506, 34 of the Indian Penal Code and 8 of the Protection of Children From Sexual Offences Act, 2012.

The allegation against the petitioner is that he along with other co-accused tried to outrage the modesty of the daughter of the informant.

Learned counsel appearing on behalf of the petitioner would submits that petitioner is not having any

Moreover, the similarly situated coaccused has been granted bail by this Court vide order dated 29.02.2020 passed in Cr. Misc. No. 7212 of 2020 (Annexure-2) Considering the aforesaid facts, this Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 50,000/- (Rupees fifty thousands) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, POCSO, East Champaran in connection with Dhaka P.S. Case No. 266 of 2019.
