JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 326, 120(B) & other minor sections of the Indian Penal Code.

Petitioner was named in the first information report but according to prosecution case itself, it was co-accused, Rahul Yadav who opened fire on the deceased and so far as petitioner is concerned; it is stated that he as well as other accused opened fire on the informant but admittedly, the informant did not sustain any injury. Moreover, petitioner is in jail custody since 22-03-2016 and except the present case as well as one Buxar (T) P.S. Case No. 477 of 2015, the petitioner does not have any criminal antecedent.
