JUSTICE MADHURESH PRASAD ORAL ORDER 31-05-2017 Learned counsel for the petitioner submits that Sakra P.S. Case No. 149 of 2017 has wrongly been typed as that of the year 2017, it should be Sakra P.S. Case No. 149 of 2007. Learned counsel for the petitioner is permitted to make necessary correction during the course of the day. Heard learned counsel for the petitioner and learned A.P.P. for the State.
Petitioner is apprehending his arrest in connection with Sakra P. S. Case No. 149 of 2007 for the offences punishable under Sections 372 and 34 of the Indian Penal Code. Submission made on behalf of the petitioner is that after investigation and supervision, the case was found to be false and final report was submitted by the police on
Patna High Court Cr.Misc. No.24300 of 2017 (2) dt.31-05-2017 2/2 31.08.2008, which is Annexure-2 of the instant petition. Further submission is that in paragraph-12, the petitioner is practicing as Homeopathic Doctor having B.H.M.S, qualification from Muzaffarpur Homeopathic College. Cognizance has been taken after a period of eight years from submission of the final report. In the facts and circumstances, in the event of his arrest or surrender within four weeks from today, the petitioner above named will be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-Cum-Sub Judge 13, Muzaffarpur in connection with Sakra P.S. Case No. 149 of 2007 subject to all conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
