This is a petition for grant of anticipatory bail for offence under Sections 324, 403, 405, 420 and 504 of the Penal Code.
There is allegation that rupees twenty five lakh was taken in pursuance of a contract entered into between the parties for supply of the material, but, the material has not been supplied. The learned counsel for the petitioner submits that this is a complaint case and, further, matter concerned with the contract entered into between the parties and submitted that the petitioner has also paid amount and shown some bank statement. However, it is the defence of the petitioner and it can not be looked into at this stage to decide the right of the

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with the Complaint Case No. 2509(C) of 2009 to the satisfaction of the Chief Judicial Magistrate, Patna, subject to the conditions laid down under Section 438(2) of the Criminal Procedure Code and subject to the condition that the petitioner shall appear in person in Court on each and every date, fixed in the case and any absence, on two consecutive dates, without any reasonable ground to the satisfaction of the Court below, shall be a ground of cancellation of bail of the petitioner by the lower Court itself and shall cooperate in the disposal of the case on day-to-day basis.
