The petitioner seeks bail in Narpatganj P.S. Case No. 255/2016, registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

The informant alleged that on sound of knocking he got up and saw five persons going from his house after committing theft. The informant claimed to identify Chandan Yadav and Mukhtar Khan (petitioner).

Learned counsel for the petitioner submits that petitioner is said to have confessed his guilt before the villagers and admitted that stolen articles were kept in the house of Bhagwat Ram, but no stolen articles were recovered from the house of Bhagwat Ram. Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj P.S.
