JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Madhepura P.S. Case No. 699 of 2016, registered under Sections 380 and 411 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Madhepura. The accusation is that the informant, Alok Kumar, being the In-charge of District Programme Manager, District Health Committee, Mdhepura, came to know that several forms, Tin Plate, Bed and other articles kept in the office are missing. On seeing of CCTV footage it was detected that, in the morning, at about 3.00 AM, materials have been stolen by 4-5 persons. Thereafter, the stolen materials were recovered to the scrap shop

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
