JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-12-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Chainpur P.S. Case No. 244 of 2017 for the offence under Sections 37 (b) of the Bihar Excise Act.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent. The name of the petitioner was disclosed by Sujeet Kumar and Mahika Singh. Learned counsel for the petitioner submits that nothing incriminating was recovered from the possession of the petitioner.

Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand)

Patna High Court Cr.Misc. No.76686 of 2018(2) dt.19-12-2018 2/2 with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I-cum-Special Judge, Excise, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 244 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
