The petitioner seeks bail in Kawakole P.S. Case No. 25/2019, instituted for offences under Section(s) 341, 323, 353, 419, 420, 504 and 506 of the Indian Penal Code read with Sections 45, 30(D) and 37(c) of the Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that on the date of occurrence police after getting information that illicit liquor is being sold in the house of Sakli Devi, went at the place of occurrence. Seeing the police party, the lady and some other persons started running away. The petitioner started altercation with Constable Shatrughan Tiwari. Thereafter he was arrested by the police. He was found in drunken condition.
Patna High Court CR. MISC. No.23405 of 2019(2) dt.11-04-2019 2/2 It is mentioned in para 3 of bail petition that one more case of Excise Act is pending against the petitioner. Learned counsel for the petitioner has submitted that petitioner is in custody since 05.02.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District Judge 2nd -cum-Special Judge, Nawada, in connection with Kawakole P.S. Case No. 25/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. The petitioner will file affidavit at the time of filing bail bond that he would not indulge in such type of activity in future. In the event, he is found indulged in such type of activity, his bail bond in the instant case will liable to be cancelled. (Sanjay Priya, J) rakhi/- U T
