Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered in connection with Madanpur P.S Case No. 53 of 2022 for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

As per the prosecution case, it is alleged that while the police officials were deputed to see law and order in a Fair on the occasion of Basant Panchami, they found that some persons have surrounded the petitioner and they have been assaulting her. On interrogation, it has been found that one Chandani Kumari, Rekha Devi and Anita Kumari have alleged that this

It is submitted by the learned counsel for the petitioner that from the seizure list, it is evident that save and except Rs. 500/- nothing has been recovered from person and possession of the petitioner. Allegation of snatching mangal sutra from the neck of three women appears to be false and concocted. It is further submitted that petitioner is lady having fair antecedent and is in custody since 06.02.2020. On the other hand, learned counsel for the State opposed the bail application of the petitioner. Having heard the rival contentions of the parties and taking into consideration the nature of allegation and moreover, petitioner is being lady and is in custody since 06.02.

2020, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Madanpur P.S Case no. 53 of 2022 subject to the condition that one of the bailors will be the close relatives of the petitioner with further conditions which are as follows:- (i) The petitioner will cooperate in conclusion of the trial.

(iii) She will not try to tamper with the evidence or intimidate the witnesses to delay the disposal of trial. (iv) In the event of default of two consecutive dates without any cogent reason, her bail bonds will liable to be cancelled.
