====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 30-10-2025 Heard learned counsel for the petitioner as well as learned APP for the State.

2. The petitioner apprehends his arrest in connection with Sugauli P.S. Case No. 70 of 2022, registered for the offences punishable under Sections 498(A) of IPC and Section 3⁄4 of Dowry Prohibition Act.

3. As per FIR, the marriage of the informant Jainab Khatun was solemnized with the petitioner on 06.04.2019. The accused persons including the petitioner tortured her for nonfulfillment of demand of dowry of Rs. 1 lakh cash and a motorcycle.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. As a matter of fact, the petitioner is ready to keep the victim with full dignity and honour but she is not ready to reside with the petitioner. His further submission is that the petitioner is a landless person having no means. He has also submitted that the petitioner is ready to pay Rs. 2,000/- per month as interim maintenance to opposite party no. 2 (the informant).

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Sugauli P.S. Case No. 70 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.

7. The petitioner is directed to pay Rs. 2,000/- per month as interim maintenance to opposite party no. 2 (the informant). The interim maintenance will be subject to any
