The petitioner seeks bail in Bhojpur Mahila P.S. Case No. 256/2016, registered for the offences punishable under Sections 498(A), 494, 379 and 34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.
The petitioner is husband of the informant against whom it has been alleged that after marriage which took place on 21st February, 2015, he started torturing her in connection with demand of Rs. 1,00,000/-. It is further alleged that on 20th May, 2016, the petitioner snatched all her belongings and went away from his house and also married a lady.
Learned counsel for the petitioner has submitted that the wife of the petitioner has lodged this case under suspicion that her
Patna High Court Cr.Misc. No.626 of 2017 (2) dt.11-01-2017 2/2 husband is indulged with another girl for which Shastri Nagar P.S. Case No. 228/2016 was also lodged. The petitioner undertakes to keep his wife with full honour and dignity. The petitioner remained in custody for about six months.
Learned Additional P.P. opposed the submission. Considering the undertaking given by the petitionerhusband and the fact that the petitioner is in custody since 28.07.2016, he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bhojpur at Ara in connection with Bhojpur Mahila P.S. Case No. 256/2016.
The lower court is directed to monitor for restoration of good relationship between the spauces in view of the undertaking given by the petitioner and further if the petitioner does not abide by the undertaking given by him, the court will be at liberty to proceed for cancellation of his bail.
