JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 22-06-2017 Heard learned for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in Mehshi P.S. Case No.233 of 2016 registered under Sections 414/34 of the Indian Penal Code.

As per the prosecution case, one co-accused Dilip Kumar Rai is said to have been apprehended with the Bolero vehicle and the said apprehended accused named the petitioner as proposed vendee of the said vehicle.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence. He has no concern with the aforesaid occurrence rather he has been named in the case by one co-accused as the proposed purchaser of the stolen vehicle. He has even not purchased the said vehicle.

No.24475 of 2017 (03) dt.22-06-2017 2/2 Considering the facts aforesaid and the nature of allegation as made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000.00 (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M. VIth, Motihari, East Champaran in Mehsi P.S. Case No.233 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
