JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 304B/201/34 of the Indian Penal Code.
Asha Kumari was married with this petitioner four years prior to her death. Her dead body was disposed of without any post mortem or information to her parents. Allegation is that since the petitioner was in extra-marital relation with his Bhabhi, which was not liked by the deceased as well as the fact that there was demand of more dowry death was committed as such.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.46351 of 2016 (4) dt.19-12-2016 2/2 the case-diary would reveal that there is conflicting evidence especially the fact that most of the witnesses have not supported the allegation of demand or extra-marital relation of the petitioner. The petitioner is in custody since 11.02.2016. Considering the nature of allegation and the period already undergone by the petitioner, he is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran/Successor Court, in connection with Ramnagar P.S. Case No.207 of 2015.
