JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 The petitioners apprehend their arrest in connection with CIS No. 56 of 2019 arising out Rafiganj P.S.Case No. 13 of 2019 registered under Sections 30(a) of the Bihar Prohibition and Excise Act.
Allegation is of recovery of 7 litres of country made liquor from the house of the petitioner no. 1 and 6 litres from the house of the petitioner no. 2 Submission of learned counsel for the petitioners is that allegation is false and concocted and there is no compliance of Section 100 Cr.P.C. and petitioners have no criminal antecedent. Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court CR. MISC. No.22276 of 2019(2) dt.08-04-2019 2/2 circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VII-cum-Special Judge, Excise Act, Aurangabad, in connection with CIS No. 56 of 2019 arising out of Rafiganj P.S. Case No. 13 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
