JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in Pirbahore P.S.Case No.159/16 registered for the offences under Sections 467, 468, 471, 472, 420 and 120(B) of the I.P.C.
The allegation against the petitioner is that while he along with others was standing at the gate of the Civil Court Patna who is said to have used to prepare fake and forged document for evidence and used to present himself as a fake witness, on seeing the police they started to flee away. But on chase the petitioner along with others was caught and on search some fake driving licence and I.D.cards had been recovered from the possession of
Patna High Court Cr.Misc. No.47822 of 2016 (4) dt.10-01-2017 2/2 the petition and others.
It is submitted on behalf of the petitioner that he has got no criminal antecedent and nothing incriminating article has been recovered from possession of the petitioner since the house from where recovery has been affected is not is exclusive possession of the petitioner. He has been falsely implicated in this case. He further submits that some similarly situated co-accused have already been granted bail by coordinate Bench vide order dated 3.10.2016 passed in Cr.Misc.No.34614/16, Cr.
Misc.No.37187/16 and Cr.Misc.No.37246/16 respectively. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Patna, in Pirbahore P.S.Case No.159/16.
