JUSTICE BIRENDRA KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147/148/149/323/387/307/504 of the Indian Penal Code and Section 27of the Arms Act.

According to F.I.R. the informant had entered into an agreement to purchase plot No.313 from his maternal uncle Mithlesh Kumar, and he was filling up the said land. In the meantime, petitioner and others variously armed came and demanded ransom. They fired from their respective fire arms. Submission of the petitioner is that the said land is recorded in the name of the father of the petitioner in the Cadastral

Patna High Court Cr.Misc. No.24460 of 2017 (3) dt.01-07-2017 2/2 Khatiyan vide Annexure-2. Father of the petitioner is paying rent and getting rent receipt vide receipt at page-15. Hence, bonafide claim of the petitioner is there.

Learned counsel for the informant opposed the prayer for anticipatory bail.

Considering the bonafide claim of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned SubJudge-XIII-cum-Additional Chief Judicial Magistrate, Patna/Successor Court in connection with Ram Krishna Nagar Police Station Case No.47 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
