The petitioner seeks bail in Korha P.S. Case No. 492 of 2020, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner is alleged to have assaulted the informant by means of sword causing multiple injuries and co-accused assaulted informant's father causing fracture injury on his leg.

It is submitted on behalf of the petitioner that there is case and counter case. Injury has been found to be lacerated. As per the injury report, there are 03 injuries on the person of informant and all are grievous in nature. Petitioner is in custody since 11.02.2021 having no criminal antecedent.

Patna High Court CR. MISC. No.33396 of 2021(3) dt.21-10-2021 2/2 Learned APP however, vehemently opposed the prayer for bail.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
