JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Chautham P.S. Case No. 124 of 2016 registered for the offences punishable under Sections 25(1-b) A, 26 of the Arms Act and Sections 47, 53 of the Bihar Excise (Amendment) Act. The allegation against the petitioner is of recovery of three live cartridges, half liter country made Mahua liquor and two liter toddy.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated by the seizure list witness, namely, Munkun Tanti, as sister-in-law (Bhabhi) of the petitioner has filed a complaint petition against the present seizure list witness namely Munkun Tanti. Having heard both sides, in view of the fact stated above and, as the petitioner has no criminal antecedent and he has remained in custody about three months, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate, IInd, Khagaria in connection with Chautham P.S.
