Versus
1. The State of Bihar.
.... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Dhirendra Kumar Sinha For the Opposite Party/s : Mr. Madhuranand Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and counsel for the State.
Apprehending his arrest in connection with Masaurhi P.S. case no. 482 of 2016, registered under Sections 436, 380/34 of the IPC, the present application is filed for grant of anticipatory bail.
It is submitted that merely on the basis of suspicion he has been named in the FIR. From the impugned order it appears that the petitioner had earlier held out threatening to the informant not to depose in a case in which her son was murdered. The delay in lodging the case has also been explained by the informant. From the impugned order it further appears that in course of investigation witnesses have supported the case. In my view, it is
Patna High Court Cr.Misc. No.24712 of 2017 (3) dt.13-07-2017 2/2 not a fit case for grant of anticipatory bail. Prayer is, accordingly, rejected.
Let the Petitioner surrender and pray for bail before the Court below. If he does so, the Trial Court shall consider his application for bail on merit unprejudiced by the present order. (Kishore Kumar Mandal, J) Shyam/- U T
