The petitioner apprehends his arrest in Ghosi P.S. case No. 115 of 2013 registered under Section 395 of the IPC. The informant along with his relatives was coming from village Usari on Indigo car and when they reached near Mananpur Chila his vehicle was stopped by two masked persons. The miscreants looted the informant and others. The informant further disclosed that the dacoits looted money from other vehicles.

The learned counsel for the petitioner submits that petitioner is a police Constable. He was enquired during the course of investigation as witness but after six years of the occurrence on the basis of the fact that a looted mobile was recovered from the possession of mother of petitioner, the police

Patna High Court CR. MISC. No.24156 of 2019(2) dt.15-04-2019 2/2 filed petition to allow further investigation. It appears that during the course of investigation many witnesses, as evident from perusal of order of learned Sessions Judge, disclosed the involvement of the petitioner and the looted mobile was recovered from the possession of mother of the petitioner.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
