JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Bajpatti P.S. Case No. 450 of 2019 registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

The petitioner is in custody since 29.12.2019. He had earlier approached this Court for grant of regular bail, which was rejected by an order dated 28.02.2020 passed in Cr. Misc. No. 10348 of 2020. It is alleged in the F.I.R. that from the petitioner's house 78 liters of foreign liquor was recovered. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.22497 of 2020(2) dt.22-01-2021 2/2 has argued that the petitioner has no criminal antecedent and there is no chance of expeditious conclusion of trial. Considering the petitioner's period of custody since 29.12.2019, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of Additional Sessions Judge-III, Sitamarhi in Bajpatti P.S. Case No. 450 of 2019.
