JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 504/34 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that on 25.2.2014 the informant being under-Raiyat of the petitioner went to the maize field and found that the accused persons are cutting maize crop on protest being made, the informant was being abused and assaulted. It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.46878 of 2014 (2) dt.27-04-2015 2/2 that for the occurrence of 25.2.2014 the FIR was registered on 1.3.2014 and admittedly as per own statement of the informant the petitioners were cutting maize crop in their own field. It is further submitted that there is nothing on record that the informant was under-Raiyat of the petitioner and no injury was caused to the informant.

Considering the delayed lodging of the case, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Khagaria in connection with Khagaria SC/ST P.S. Case No. 14 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
