Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Petitioner seeks bail in a case registered under section 307 and other minor sections of the Indian Penal Code. There is allegation that the petitioner assaulted injured Punita Devi who sustained injury on her abdomen and the informant claims that the aforesaid injured Punita Devi was carrying pregnancy at the time of alleged occurrence. The impugned order goes to show that three injuries were found on the person of injured Punita Devi and opinion regarding injury on abdomen of injured Punita Devi was kept reserved for want of USG of abdomen but at para 10 of the petition, it has specifically pleaded by the petitioner that the aforesaid injured Punita Devi did not consult to any lady doctor nor produced any report of USG. So, the aforesaid fact goes to show that she had not sustained

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that there is case and counter case between the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Sheikhpura in Ariyari (Kasar) P.S. Case no. 84/2016.
