Petitioner seeks bail in connection Singheshwar P.S. Case no. 256 of 2020 registered for the offence punishable under sections 30(a) and 30(c) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 04.01.2021 and charge sheet has been submitted. Allegation is of recovery of 65 liter Indian made foreign liquor from banana orchard alleged to be kept by this petitioner. Learned counsel for the petitioner further submits that petitioner was not present at the time of recovery nor he was arrested at the place of occurrence nor he had connection

Patna High Court CR. MISC. No.33888 of 2021(2) dt.01-12-2021 2/2 with the said banana orchard.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody since 04.01.2021 and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge (Excise), Madhepura in Singheshwar P.S. Case no. 256 of 2020.
