1. Heard learned Senior counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 25(1-b)a and 26 of the Arms Act.

3. Learned Senior counsel for the petitioner submits that the petitioner has antecedent of two cases but then both the cases are complaint cases filed by partner of the petitioner and the informant alleges that when he had gone to comply the process under Section 83 of the Cr.P.C., in relation to one of the complaints, then 99 cartridges were recovered from the house of the petitioner.

4. Learned Senior counsel for the petitioner submits that the petitioner has been falsely implicated in the present

No.27591 of 2023(2) dt.24-07-2023 2/2 case, it is next submitted that the petitioner is a rich businessman and has property in Bihar, Jharkhand and at other places and thus had kept bodyguard for his protection. It is further submitted that from perusal of Annexure-2 it would manifest that an application under 457 of the Cr.P.C. has been filed for releasing the cartridges which were seized by the police.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned Senior counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rajgir P.S. Case No. 380 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
