The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.
It is alleged that 19 bags of rice loaded on a truck were seized. The driver of the vehicle stated that the rice was given by the petitioner to be delivered to Kanhaiya Sah at Farbisganj.
It is submitted that nothing has been recovered from the possession of the petitioner and the petitioner has no concern with the said rice and a statement has been made in paragraph-3 of the petition that the petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.50393 of 2014 (2) dt.27-04-2015 Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Fulkaha P.S. Case No.40 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., Araria subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
