JUSTICE SHIVAJI PANDEY ORAL ORDER 11-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in Sherghati (Dobhi) P.S. Case No.160 of 2017 instituted for the offences under Sections 272, 273, 414 of the Indian Penal Code and Sections 30(A) of the Biahr Excise Act, 2016. The police has intercepted a car bearing registration BR 2 R 0173 and from there huge quantity of liquor was recovered.

Learned counsel for the petitioner submits that petitioner has only handed over the car and he has no knowledge about the alleged recovery.

In such view of the matter, this Court is not inclined to

Patna High Court Cr.Misc. No.24808 of 2017 (2) dt.11-07-2017 enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of three weeks, the court below will pass an order on the same day on its own merit without being prejudiced by the order passed by this Court.
