This is a petition for grant of anticipatory bail for offence under Sections 323, 341, 342, 353, 504 and 506 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that after the flag hoisting ceremony, the petitioner and others created disturbance in continuance of further programme and also abused and assaulted causing obstructing in discharge of official duty of the informant. Submission of the learned counsel for the petitioner is that some other co-accused has already been granted anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 13184 of 2017 and the informant has given in writing that the petitioner was not there at the time of occurrence. Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Madhuban P.S. Case No. 19 of 2017 to the satisfaction of

Patna High Court Cr.Misc. No.24700 of 2017 (3) dt.06-07-2017 2/2 the Chief Judicial Magistrate, East Champaran at Motihari, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
