The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406,379 and 420 of the Indian Penal Code. It is alleged that two trucks were jointly purchased, one truck came in possession of the father of the informant and other came in possession of the uncle of the informant. The petitioner is the step brother of the informant who was given the truck to ply but subsequently he claimed that the same has been stolen but the petitioner came to know that by getting it reregistered at Calcutta the petitioner is plying the same.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.50445 of 2014 (2) dt.27-04-2015 petitioner that the accusation was found false and final form was submitted but subsequently D.I.G ordered for further investigation and directing the officials to arrest. Moreover, title suit is pending between the petitioner and the informant.
Considering the nature of accusation, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Sakra P.S. Case No.223 of 2010 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.
Muzaffarpur subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
