JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-06-2017 Heard the learned counsel for the petitioner, the learned A.P.P. for the State as also the learned counsel for the complainant.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Complaint Case No. 768C of 2015/ Special Case (S.C) No. 958 of 2016 for the offence punishable under section 498-A of the I.P.C.
The complainant was married to the petitioner on 15.05.2013 and thereafter the petitioner and other in-laws started demanding dowry by way of cash Rs. 25,551/- from the father of the complainant. They again started torturing and assaulting her
Patna High Court Cr.Misc. No.12316 of 2017 (5) dt.23-06-2017 2/2 for non fulfillment of additional demand of Rs. 3,00,000/- and ultimately on 09.04.2015 after assaulting her and snatching all ornaments and cloths ousted her from the in-laws house and since then the complainant is residing in her father's house. Submission is of false implication and that the petitioner was/ is always ready to keep the complainant as his wife with honour and dignity but the complainant does not want to live with the petitioner, all the allegations of the complainant is absolutely false and concocted, the complainant wants to keep the petitioner as Gharjamai and as such the petitioner deserves sympathetic consideration.
The learned A.P.P. and the learned counsel for the complainant opposes prayer for pre-arrest bail of the petitioner by submitting that the petitioner is the husband and he is responsible for all these acts.
In the facts and circumstances as stated above, considering the allegation attributed against the petitioner, I am not inclined to grant privilege of pre-arrest bail to the petitioner and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of S.D.J.M, West Champaran at Bettiah.
