Petitioners apprehend arrest in Muffasil PS Case No. 194 of 2018 registered under Sections 439, 448, 341, 323, 327, 379, 354(B), 385 and 506/34 of the IPC. It is submitted by Counsel for the petitioners that the petitioners are innocent and have not committed any offence. He submits that against petitioner No. 2 the allegation is only of being a member of the unlawful assembly. In respect of petitioner No. 1, it is submitted that there is no allegation of assault and merely ornamental allegation regarding snatching of ornaments has been attributed against petitioner No. 2. Considering the aforesaid submissions as also the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of their arrest or surrender before the court below within four weeks from today, let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri. D. Singh, Judicial Magistrate, lst Class, Katihar in Muffasil PS Case No. 194 of 2018 subject to all conditions as laid down in Section 438(2) of the Criminal Procedure Code.
