27.04.2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends arrest in connection with Bhagwan Bazar P.S. Case No. 219 of 2013 dated 03.12.2013 instituted under Sections 366A/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that in the entire prosecution story, the main allegation is against Deepak Solanki, who is said to have married the daughter of the informant initially and the petitioner is said to have facilitated the same. It is further alleged that later on the marriage was annulled upon pressure from the informant by an agreement. It is alleged that two persons had come from Gujarat and behind the back of the informant, they had taken away the daughter of the informant on the false pretext that

It is submitted that the Deepak Solanki was a worker in the Air Conditioner business of the brother-in-law (Dewar) of the petitioner and she being a lady having clean antecedent has been falsely implicated having no role in the entire episode. Learned counsel has produced web copy of the order dated 21.07.2014 passed in Cr. Misc. No.12740 of 2014, by which the two persons who are accused have taken the son of the informant to Gujarat have been granted bail.
Learned A.P.P., upon going through the case diary, submits that the first marriage of the petitioner with Deepak Solanki was with the help of the petitioner. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Bhagwan Bazar P.S. Case No. 219 of 2013, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973. (Ahsanuddin Amanullah, J.) P. Kumar U T
