Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-11-2021 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Kargahar P.S. Case No. 33 of 2020 instituted for the offences under Sections 147, 148, 149, 323, 341, 342, 338, 427, 307, 353, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are in custody since 11.02.2021, charge-sheet has been submitted in the case and petitioners are persons with clean antecedent.

Learned counsel for the petitioners submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant alleges that when he along with

Patna High Court CR. MISC. No.32877 of 2021(2) dt.29-11-2021 2/2 police force went to clear the encroachment, the accused persons formed mob and assaulted the informant and the police party and also threw brick-bats on the driver of the JCB which is also alleged to have been damaged by the mob.

Learned counsel for the petitioners submits that nothing specific has been alleged against the petitioners, the allegations are general and omnibus in nature and co-accused have been granted anticipatory bail vide order dated 05.03.2021 in Cr. Misc. No. 31878 of 2020.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody since 11.02.2021, charge-sheet has been submitted in the case and the petitioners are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Sasaram, Rohtas in connection with Kargahar P.S. Case No. 33 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C.
