JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. Although, the petitioner is said to have been caught on the spot, while, he was making preparation for committing dacoity but according to prosecution case, itself, nothing was recovered from the conscious possession of the petitioner and more over, having more or less similar allegation, one co-accused has already been granted privilege of bail, by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as

No.42585 of 2016 (2) dt.06-10-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt.
