JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner, learned counsel for informant as well as learned Addl. Public Prosecutor. The application is for grant of bail in connection with Bhagwan Bazar PS case no. 184 of 2016 for the offence under Section 302/34 of the Indian Penal Code. It is submitted on behalf of petitioner that petitioner is the husband and there is general allegation against him. It is further submitted that in post mortem report, there is no injury on the person of the deceased and the death is caused due to hanging.

Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail by submitting that earlier also, some occurrence took place in which petitioner was caught by police.

Patna High Court Cr.Misc. No.3770 of 2017 (2) dt.10-02-2017 2/2 Moreover, he is the husband and he is not entitled for bail. Having heard both sides. In view of the abovestated facts, as the petitioner is the husband, I am not inclined to grant bail to the petitioner. As such, his prayer for bail is rejected at this stage. However, lower court is directed to expedite the trial and conclude the same preferably within 09 months and if the trial is not concluded within stipulated time, petitioner may renew his prayer for bail before the court concerned.

With these observations, this bail application is dismissed.
