JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Ram Nagar P.S. Case no. 82 of 2017, registered under Sections 147, 148, 149, 323, 324, 325, 447, 448, 307, 354, 395, 504 and 506 of the Indian Penal Code.
The accusation is that 12 persons named in the F.I.R. including the petitioners along with 15 to 20 unknown boarding on motorcycles and tractor having arm with axe, Farsa, Lathi, stick and
Patna High Court Cr.Misc. No.27948 of 2017 (5) dt.09-11-2017 2/2 deadly weapon came at the door of the informant. Md. Jahid Khan with intention to commit dacoity. At that time, Guddu Kha caused injury at his head through butt of the pistol and petitioner No.4 took cash of Rs. 25,000/- breaking the box and Abdulah Ansari also took ornaments from another box.
Learned counsel for the petitioners submits that petitioners are relative of co-accused Guddu Kha and due to land dispute in between petitioner and co-accused Guddu Kha, the present case has been lodged.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the SDJM, Bagha in connection with Ram Nagar P.S. Case No. 82 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
