JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 The petitioner seeks regular bail in connection with S.T. No. 482/18 arising out of Ghanshyampur P.S. Case No. 185 of 2017, registered for offences punishable under Sections 147, 148, 149, 307, 324, 302/504 of the Indian Penal Code. Allegation against the petitioner and others is of assault to the informant, her daughter and her husband. Earlier the prayer for bail of the petitioner was dismissed vide order dated 31.10.2018 passed in Cr. Misc. No. 52545 of 2018 with liberty to the petitioner to renew his prayer for bail after framing of charge.
Submission of learned counsel for the petitioner that only general and omnibus allegation has been levelled against
Patna High Court Cr.Misc. No.857 of 2019(2) dt.16-01-2019 2/2 the petitioner and he has been in judicial custody since 06.06.2018 and there is no likelihood of conclusion of trial in near future.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II, Benipur at Darbhanga, in connection with S.T. No. 482/18 arising out of Ghanshyampur P.S. Case No. 185 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
