The petitioner seeks bail in Goh P.S. case No. 37 of 2012 under Section 436 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.

The informant lodged the case against unknown for setting ablaze machines and other articles.

The learned counsel for the petitioner submits that after three years of the occurrence one Mritunjay Mishra was arrested and he is said to have confessed his guilt. Mritunjay Mishra disclosed the name of petitioner but Mritunjay Mishra has already been granted bail vide order passed in Cr. Misc. No. 24394 of 2015. The petitioner is a social worker and he has no manner of concern with extremists group.

No.39528 of 2016 (3) dt.28-11-2016 2/2 Considering the facts aforesaid and the fact that except confessional statement of Mritunjay Mishra the I.O. did not collect any tangible material against the petitioner and the petitioner is in jail since 13.07.2016, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Daudnagar in Aurangabad P.S.
