The petitioners apprehend arrest in connection with Uchakagaon P.S. Case No. 226 of 2016 registered under Sections 147, 148, 149, 323, 354B, 427, 379, 504, 506 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that the allegations are general and omnibus.
Patna High Court Cr.Misc. No.24337 of 2017 (3) dt.06-07-2017 Nothing specific has been alleged against these petitioners. Some anti-social element tried to enter in Durga Temple on the occasion of Muharram, which was objected by Hindu people, for that Block Development Officer lodged first information report vide Uchakagaon P.S. Case No. 221 of 2016. Besides that, people of both community started lodging criminal cases against each other. The present case is also one of them. Petitioners have no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Uchakagaon P.S. Case No. 226 of 2016 subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Manish/- U T
