Prayer for bail of this petitioner has already been rejected by this Court on 16.12.2015 in Criminal Miscellaneous No.55745 of 2015.

So far the submission of learned counsel for the petitioner that one of the co-accused has already been granted bail by this Court is concerned, it may be mentioned here that at the time of passing the order, the order passed by this Bench was not brought to the notice of the Bench, who granted bail and from perusal of the order it appears that the co-accused has already been granted bail on the ground that he had not taken active part in the kidnapping of the victim girl. Therefore, the case of the coaccused, who has been granted bail, is on different footing.

Patna High Court Cr.Misc. No.45842 of 2016 (2) dt.26-10-2016 Accordingly, this criminal miscellaneous application is dismissed.
