====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-04-2024 Heard Mr. Sheo Nandan Prasad, learned counsel appearing on behalf of the petitioners and Mrs. Pushpa Sinha No.1, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Warsaliganj P.S. Case No. 59 of 2024 registered for the offence punishable under Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act, 2016.

3. Allegation is of recovery of 30 litres of country made liquor from near the canal.

4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and they have falsely been implicated in the case. They have no concern either with the seized liquor or trade of liquor in any manner.

5. Learned APP for the State vehemently has opposed the prayer for grant of pre-arrest bail to the petitioners.

6. Considering the nature of allegation against the petitioners, the petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge Court-2, Nawada in connection with Warsaliganj P.S. Case No. 59 of 2024, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
