JUSTICE SUDHIR SINGH ORAL ORDER 02-12-2016 Learned counsel for the petitioners seeks permission to withdraw this petition against petitioner no. 2. Permission is accorded.

This petition is dismissed as withdrawn against petitioner no. 2.

Heard learned counsel for the petitioner no. 1 and the State.

The petitioner no. 1 is apprehending his arrest in a case instituted under Section 273 of the Indian Penal Code and Section 47 (a) of the Bihar Excise (Amendment) Act, 2016. Allegation against petitioner is that from his possession foreign liquor was recovered.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that 3.750 litres of foreign liquor is said to have been recovered from possession of petitioner. No compliance under Section 100 of the Code of Criminal

Patna High Court Cr.Misc. No.51229 of 2016 (2) dt.02-12-2016 2/2 Procedure is made.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VIth, Purnea, in connection with Amour P.S. Case no. 110 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
