The petitioner prays for grant of bail in Khaira P.S. Case No. 201 of 2016, registered under Section 392 of the Indian Penal Code.

The F.I.R. was lodged against unknown alleging that while he was traveling on a motorcycle with cash, four accused persons intercepted him and looted his motorcycle and cash. In course of investigation, one Nandan Kumar Singh was arrested on 31.07.2016, who is said to have named Sanjeev @ Awadhesh Kumar Singh, Prabhat Kumar Singh and Jay Prakash Ram. On the confession of Jay Prakash Ram @ Prakash Ram, one stolen motorcycle was seized. Jay Prakash Ram further stated that part of the looted cash has been deposited with the petitioner, which can be recovered. Further allegation is that one

Patna High Court Cr.Misc. No.47724 of 2016 (3) dt.22-11-2016 2/2 motorcycle was also seized from the house of the petitioner, which was claimed by his brother. It is said the said motorcycle has been released in favour of the brother of the petitioner. The petitioner has no criminal antecedent and he is in custody since 10.08.2016.

Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No.201 of 2016 subject to the following conditions: (i) One of the bailers shall be the own/close family members of the petitioner.

(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
